    2017 Post-Election Watch List  

    In this session, we will review employment related regulations on the new Presidential administration's short list we anticipate being overturned. Join us as we review the current and pending regulations and discuss the future of the employment and labor laws and the potential and presumable impact on your business! 

    Speaker Information

      

    Carol C. Barnett serves both as a trial lawyer and as a counselor to clients on preventive strategies to avoid employment-related litigation. She has extensive jury trial experience and counsels and litigates on behalf of numerous business and governmental entities on a wide range of employment-related matters, including ADA, FMLA, Title VII, retaliatory discharge, wage and hour issues, and age discrimination. Ms. Barnett’s defense work includes cases brought in federal and state courts, as well as administrative agency charges. She has successfully handled dispositive motions in employment law and other matters. 

    Ms. Barnett has previously worked as an assistant prosecutor for Buchanan County (1986-1991), where she handled a variety of complex criminal matters, ranging from homicide prosecutions to child sex abuse jury trials. She also handled civil cases for the Prosecutor’s Office.

    Ms. Barnett regularly conducts training and seminars on hostile work environment issues and other areas of employment law of interest to businesses and government entities. She also frequently makes presentations to various community groups on legal issues. Prior to attending law school, Ms. Barnett worked for three years in employee relations/employee communications for Armstrong World Industries, a Fortune 500 company, in its corporate headquarters in Lancaster, Pennsylvania.

    Changes to the DOL Wage & Hour Regulations and EEO-1 Reporting Impacts

    Join us for an updated discussion of the DOL changes to the white collar exemptions, the phase-in of those regulations, suggestions for compliance, and pitfalls to avoid. In addition, we will discuss the EEO-1 reporting requirements for wage payments and hours and what the EEOC plans to do with the information and how all of this impacts 2017 operations.

     Robert Hingula, Attorney, 

    Robert Hingula primarily focuses his practice on trial and counseling work involving labor and employment law.  Most recently, he has devoted a significant amount of his practice to representing employers in various industries in collective actions brought pursuant to the Fair Labor Standards Act.  As part of his representation, Mr. Hingula has advised and assisted clients with restructuring their compensation policies to comply with state and federal wage and hour laws.  Some of the industries Mr. Hingula has represented and counseled in wage and hour issues include financial institutions, mortgage companies, cable installation companies, waste and disposal companies, medical facilities, maintenance companies, and educational institutions.

    Mr. Hingula also routinely counsels and represents school districts through various employment and education law issues, including due process hearings, student discipline procedures, implementation of district-wide policies, and grievances. He has successfully defended districts in arbitrations brought by teachers challenging the districts' decision to terminate their employment.  Mr. Hingula also routinely provides training to district employees regarding various employment practices, and has assisted districts in properly investigating employee and student complaints regarding various issues including discipline, harassment/bullying, discrimination, and statutory compliance.

    In addition to his background in wage and hour law and the education realm, Mr. Hingula has experience defending employers in both state and federal court and before state and federal agencies against allegations of sexual harassment, retaliation, wrongful discharge, and discrimination claims including age, race, disability, religious, and sex discrimination.  He also advises employers on compliance with various state and federal statutes including the Uniformed Services Employment and Reemployment Rights Act, the Family Medical Leave Act, and the Fair Labor Standards Act.  Mr. Hingula has also represented employers and employees in several cases involving non-compete covenants and non-solicitation agreements.
