Program Description:
Wage and Hour collective actions have become the “case de jour” in the last several years. Increased litigation has caught the attention of the U.S. Department of Labor who has begun processes of extremely limiting exemptions under the Fair Labor Standards Act. Along with those limitations, the DOL has increased its investigation and audit processes. This seminar will review the fundamentals of the FLSA and collective action litigation, as well as give helpful hints in preparing for and surviving DOL audits.
Presenter Information:
Robert Hingula combines a deep understanding of the law with a unique ability to think outside the box, often helping clients avoid employment-related disputes long before they enter the courtroom. Robert’s tireless work ethic not only ensures that clients are legally compliant, but provides them an approached tailored to their specific business needs and culture.
If a matter does require litigation, Robert has the experience necessary to zealously advocate and defend companies involved in a variety of employment disputes and litigation. Robert devotes a significant amount of his practice to representing employers from various industries in collective actions brought pursuant to the Fair Labor Standards Act. As part of his representation, Robert advises and assists clients with restructuring their compensation policies to comply with state and federal wage and hour laws, avoiding misclassifications and violations.
In addition to his background in wage and hour law, Robert has experience in:
- Defending employers in both state and federal court and before state and federal agencies against allegations of sexual harassment, retaliation, wrongful discharge, and discrimination.
- Advising employers on compliance with various state and federal statutes including Title VII, the Uniformed Services Employment and Reemployment Rights Act, the Family Medical Leave Act, the Americans with Disabilities Act, and the Age Discrimination in Employment Act.
- Drafting, defending, and prosecuting non-compete covenants and non-solicitation agreements.
- Evaluating and revising employer policies and practices.
- Assisting employers with employee discipline, termination, and layoffs.
Robert routinely counsels and represents school districts through various employment and education law issues, including due process hearings, student discipline procedures, implementation of district-wide policies, and grievances.
He has successfully defended districts in arbitrations brought by teachers challenging the districts' decision to terminate their employment. Robert also routinely provides training to district employees regarding various employment practices and has assisted districts in properly investigating employee and student complaints regarding various issues including discipline, harassment/bullying, discrimination, and statutory compliance.

HRMA of Northwest Missouri is recognized by SHRM to offer 1.5 Professional Development Credits (PDCs) for the SHRM-CP or SHRM-SCP.
